Terms of Service

These Terms of Service ("Terms") govern your access to and use of the kcaldata API and website (the "Service"), operated by Sea Blast LTD ("kcaldata", "we", "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

kcaldata provides a programmatic interface that returns estimated nutrition information — primarily calorie values — in response to food-description queries. Nutrition values are derived from the U.S. Department of Agriculture's FoodData Central datasets, which are in the public domain. kcaldata is an independent service and is not affiliated with, endorsed by, or sponsored by the USDA.

2. Not nutritional, dietary, or medical advice

The Service returns estimates for informational purposes only. Outputs are not, and must not be relied upon as, medical, nutritional, dietary, or health advice, and are not a substitute for consultation with a qualified professional. Do not use the Service to make medical or dietary decisions, and do not present its outputs to end users as authoritative nutritional guidance without your own review. You are responsible for how you use and display the Service's outputs.

3. Accuracy and availability

We work to keep the Service useful and accurate, but we provide it "as is". We do not warrant that outputs will be accurate, complete, current, or suitable for any particular purpose, or that the Service will be uninterrupted or error-free. Food matching is automated and may return an incorrect or approximate match. You are responsible for validating outputs before relying on them.

4. Access tiers and acceptable use

The Service offers a free tier subject to rate limits (for example, a daily request cap), and paid access. We may change, limit, or discontinue any tier at any time. You agree not to:

• exceed, evade, or interfere with rate limits or access controls (including by rotating IP addresses or keys to circumvent limits);
• resell, redistribute, or sublicense the Service in a way that competes with it, or scrape it to rebuild a substantially similar dataset for redistribution;
• use the Service unlawfully, or to build anything that promotes self-harm, disordered eating, or other harmful behavior;
• attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its infrastructure.

We may suspend or terminate access that violates these Terms or that threatens the Service's stability.

5. API keys

If you are issued an API key, you are responsible for keeping it confidential and for all activity under it. Notify us promptly at kcaldata@protonmail.com if you believe a key has been compromised.

6. Payments (crypto / x402)

Certain endpoints require payment. Payments are made in cryptocurrency (currently USDC on the Base network) using the x402 payment protocol, settled on-chain by a third-party facilitator. By making a payment you acknowledge:

• prices are quoted at the time of the request and denominated as stated in the payment challenge;
• on-chain payments are generally irreversible, and — except where required by law — payments are non-refundable;
• settlement depends on third-party blockchain infrastructure we do not control, and we are not liable for network delays, failures, gas costs, or fluctuations in cryptocurrency value;
• you are solely responsible for the wallet and funds you transact with, and for any taxes arising from your use.

7. Intellectual property

The underlying nutrition data is public-domain USDA data. The Service's software, matching logic, presentation, and brand are owned by us. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to call the Service and use its outputs in your own applications.

8. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total aggregate liability for any and all claims relating to the Service will not exceed the greater of (a) the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred United States dollars (US$100).

10. Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service or your breach of these Terms.

11. Changes

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Saint Vincent and the Grenadines, without regard to conflict-of-laws principles. You agree that the courts of Saint Vincent and the Grenadines have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
